[기자회견] 제14차 ILO 아태총회 노동자그룹의 한국노동기본권 보장촉구를 위한 기자회견

5.취지:제14차 ILO 아태총회 노동자그룹은 한국의 노사관계와 노동자의 기본권보장이 악화되고 있는 현 상황에 대한 개선을 위해 한국정부에게 아래와 같은 내용을 촉구하는 기자회견을 개최하였습니다.

[기자회견문]한국 노사관계에 대한 제14차 ILO 아태총회 노동자그룹 성명서  

제14차 ILO 아태총회 노동자그룹은 노동자와 노동조합의 권리가 심각하게 침해되는 등 악화일로에 있는 한국의 노사관계에 대해 깊은 우려를 표명한다.
우리는 노동자 권리를 보호하기 위한 한국 노동자 동지들의 투쟁에 전폭적인 지지와 연대를 보내는 바이다.

우리는 제14차 ILO 아태총회 기간 중인 8월 30일, 노동부장관이 노사정간에 협상이 진행되고 있음에도 불구하고 현행법에 규정된 노동권 제한을 개정하라는 노동계의 요구를 수용하지 않겠다고 발언한 것에 대해 깊은 유감을 표명한다.

우리는 노동자의 기본권을 수호하고 임금과 노동조건을 개선하기 위한 평화적인 집회와 시위에 참여한 노동자들에 대해 경찰이 잔인하게 폭력을 행사한 것을 규탄한다. 그러한 탄압으로 말미암아 두명의 노동자가 사망했고 수많은 부상자가 발생했을 뿐 아니라, 최근에는 100명이 넘는 노조원들이 구속되었다. 우리는 구속된 노조원 전원을 즉각 석방할 것을 요구한다.

우리는 또한ILO아태총회가 개최되고 있는 중에도 많은 노조사무소를 폐쇄함으로써 공무원의 결사의 자유를 위반하고 있는 데 대해 강력하게 비난한다. 우리는 한국정부가 ILO 핵심 노동기준에 명시된 노동자권리를 존중할 것을 촉구한다.

2006년 3월, ‘ILO 결사의자유위원회’에서 채택된 결론을 상기하면서 ILO 노동자그룹은 한국정부가 다음과 같이 조속히 노동법을 개정할 것을 강력하게 촉구한다.

공무원의 권리를 전적으로 보장할 것

1. 5급 이상 공무원의 노조결성권을 보장하고, 이들의 범위를 광범위하게 규정함으로써 다른 공무원 조직을 약화시키지 않도록 할 것.
2. 소방공무원들의 단결권을 보장할 것

3. 파업권에 대한 제약은 결사의자유위원회에서 규정하고 있는 필수 서비스에 종사하는 공무원으로 최소화 할 것.

4. 교섭 당사자가 노조전임자의 노조활동에 대한 무급휴가 처리 여부에 대해 스스로 결정하도록 할 것.

5. 이미 수년간 스스로 노조설립이라는 기본권을 행사해 온 공무원노조 사무실에 대한 폐쇄명령을 철회할 것.


모든 노동자와 관련하여, 노동자그룹은 정부에 다음과 같이 촉구한다:

1 모든 노동자가 스스로 노조를 결성하고 가입할 수 있는 권리를 보장받을 수 있도록단위사업장  복수노조의 입법화를 위해 신속한 조치를 취하라.

2 노조전임자 임금 지급 문제에 대해서는 노사가 자유롭게 자발적으로 협상하도록 하라.

3 ‘노동조합및노동관계조정법’상의 필수 공공서비스 목록을 개정하여 엄격한 의미에서의 필수서비스에만 파업권이 제한되도록 하라.  

4  단체교섭이라는 기본권 행사를 위하여 구속을 포함한 통고 요건과 과중한 벌금 부과를 폐지하라.

5  해고 또는 실업자의 조합원 자격 유지 금지 조항 및 비조합원의 노조간부직 출마 자격 불인정 조항을 폐지하라.  

6 형법 제314조(업무방해) 조항을 결사의 자유 원칙에 부합되도록 함으로써 수사 중 기본권을 행사하고자 하는 노동자를 구금하지 못하도록 하라.

7  집회에서의 경찰개입, 조합원 상해, 노조간부 및 조합원에 대한 위협과 괴롭힘 등 양대노총의 활동을 방해하는 일체의 행동을 삼가하라.
8  노조간부에 대한 협박과 괴롭힘 등의 모든 행위가 즉각 중지될 수 있도록 적절한 지침을 내리고, 모든 유죄판결과 징역형 선고에 대해 재검토하며, 노조간부의 기소, 구금, 투옥 등에 따른 모든 피해를 보상하라.

9  하청업자에 의해 고용된 모든 노동자들에 대한 단체협약 적용을 전면적으로 인정하도록 하라.

결론적으로, 우리는 한국정부에게 위의 쟁점들이 확실하고 신속하게 해결될 수 있도록 양대노총과의 충분한 협의와 성실한 협상을 통해 ‘로드맵’을 종결지을 것을 촉구한다.

우리는 또한 ILO에 한국 노동자권리를 보장하기 위한 양대노총의 적법한 주장과 관련해 양대노총을 지원하기 위한 모든 적절한 조치를 취할 것을 촉구한다.

[영문] STATEMENT FROM WORKERS’ GROUP OF THE ILO 14TH ARM HELD IN BUSAN KOREA ON THE WORSENING INDUSTRIAL RELATION SITUATION IN KOREA,  31 AUGUST 2006

The Workers’ Group of the 14th Asian Regional Meeting is deeply concerned over the worsening labour situation in Korea where serious violations of workers and trade union rights are taking place. We extend our full support and solidarity to our Korean trade union brothers and sisters in their struggle to uphold workers’ rights.
We deeply regret the Minister of Labour’s remarks made on 30th August 2006, whilst the ILO 14th ARM is in progress and despite the fact that negotiations are still continuing between the three parties, that he would not accept the proposals from labour to revise restrictions on workers’ rights in the current legislation.
We condemn the violence and police brutality perpetrated against workers involved in peaceful rallies and demonstrations to uphold their fundamental rights and improve their wages and working conditions. Such aggression had caused the deaths of two workers and injuries to many others and led in recent months to the imprisonment of more than one hundred unionists. We demand the immediate release of detained trade unionists.
We also strongly condemn the violation of public servants’ right to freedom of association with the closure of many union offices even during this ARM. We urge the government of Korea to honour and respect workers’ rights as embodied under the ILO core labour standards.
Recalling the Conclusions adopted by the ILO Committee on Freedom of Association at its March 2006 sitting, the Workers’ Group strongly urges the Korean government to promptly make the following changes in its labour legislation:
(a) fully guarantee the rights of public employees by:
(i) ensuring that public servants at Grade 5 or higher have the right to form their own associations and not to define this category of staff so broadly as to weaken the organizations of other public employees;
(ii) guaranteeing the right of firefighters to establish and join organizations of their own choosing;
(iii) limiting any restrictions of public servants’ right to strike only to those who are in the essential services as defined by the CFA;
(iv) allowing the negotiating parties to determine on their own whether trade union activity by full-time union officials should be treated as unpaid leave;
(v)  reversing the order to close down offices of public employees’ unions that have excercised their fundamental right to establish organizations of their own choosing for several years already.
In respect of all other workers, the Workers’ Group also urges the Government:
(i) to take rapid steps for the legalization of trade union pluralism at the enterprise level so as to guarantee at all levels the right of workers to establish and join the organization of their own choosing;
(ii) to enable workers and employers to conduct free and voluntary negotiations in respect of the question of payment of wages by employers to full-time union officials;
(iii) to amend the list of essential public services in the Trade Union and Labour Relations Amendment Act (TULRAA) so that the right to strike may be restricted only in essential services in the strict sense of the term;
(iv) to repeal the notification requirement and the heavy penalties, including imprisonment, for exercising the fundamental right of collective bargaining;
(v) to repeal the provisions prohibiting dismissed and unemployed workers from keeping their union membership and making non-union members ineligible to stand for trade union office;
(vi) to immediately bring section 314 of the Penal Code (obstruction of business) in line with freedom of association principles, ensuring that investigations will not include detention for workers that have tried to exercise their fundamental rights;
(g) to refrain from any act of interference in the activities of FKTU and KCTU, such as violent police intervention in rallies, injury of trade unionists, intimidation and harassment of trade union leaders and members;
(h) to issue appropriate instructions so that all actions of intimidation and harassment against the unions officials cease immediately, to review all convictions and prison sentences, and to compensate officials for any damages suffered as a result of their prosecution, detention and imprisonment;  
(i) to promote the full recognition that collective agreements apply to all workers hired by subcontractors.

In conclusion, we urge the Government of Korea to finalise the “roadmap” in full consultation and bona fide negotiation with FKTU and KCTU in order to positively and promptly address the above issues.

We also urge the ILO to take all the appropriate steps to assist FKTU and KCTU in their legitimate claim to uphold workers’ rights in Korea.
