국제자유노련 노대통령에 항의 서한
노동자 잇단 자결 노동탄압 결과 … 손배 가압류 ILO 협약 위반 제소 지원
1. 전세계 150개 국가 1억 5천 8백만 명이 가입된 세계 최대 노동조직인 국제자유노련(ICFTU)은 최근 한국 노동자들의 잇단 자살 항거와 관련 노무현 정부에 항의서한을 보냈다고 민주노총에 알려왔습니다.
이 서한에서 국제자유노련은 "손배가압류를 이용한 반노동조합적 행동들은 ILO 협약 제87조(결사의 자유와 단결권 보호에 관한 협약, 1948)와 98조(단결권과 단체협상권 원칙에 관한 협약, 1949)에 위배된다"며, "이러한 협약들을 존중하고 집행하는 것이 ILO 회원국으로서의 한국의 의무이기 땜누에 한국 노동법의 개혁과 노동자들의 단체행동권을 탄압하기 위한 목적으로 사용자들이 부당하게 손해배상 제도를 활용하는 것을 금지해줄 것을 강력하게 요구한다"고 밝혔습니다.
또한 국제자유노련은 최근 사태와 관련해 이미 국제금속노련(IMF)이 한국 정부를 ILO에 제소하기로 결정했다며, ICFTU는 이 제소를 전적으로 지원하고, 이를 위해 필요하다고 생각되는 모든 형태의 행동을 취할 것이라고 밝히고, 노무현 대통령에게 "귀하가 즉각적으로 개입하여, 귀국 정부가 사회적 대화에 착수하고 노동조합 기본권에 대한 존중을 보장해줄 것을 진심으로 바란다"고 촉구했습니다.

한국 사법 제도가 노동조합과 노동자 권리를 탄압하는 데 사용되고 있는 것에 관하여
귀국을 포함하여, 150개 국가 1억 5천 8백만 명의 노동자를 대표하는 국제자유노련은 한국 금속 노동조합원들의 연이은 자결이라는 결과를 낳고 있는 대한민국의 최근 심각한 사태 전개에 대해 강력하게 비난하는 바입니다.
ICFTU는 이러한 비극적인 죽음의 근본적인 이유는 기업의 엄청난 손해배상 청구, 노동조합 및 개별 조합원 재산에 대한 가압류 등을 통해 한국에서 노동조합 권리와 활동을 지속적으로 탄압하고 있기 때문이라고 확신합니다.
다른 나라들과는 다르게, 귀국 민법은 불법 행동을 한 조합원들이 손해배상 소송을 당할 수 있도록 명기되어 있습니다. 반면, 한국 노동법은 노동자들의 합법적인 단체 행동을 제한하고 있어서, 다소 구조적으로 법원에 의해 불법으로 간주됩니다. 그러면 사용자들은 통상적으로 엄청난 금액의 손해배상을 청구하게 됩니다. 따라서 문제의 핵심은 손배·가압류라는 사법 제도가 아니라, 사용자들이 이러한 사법 제도를 노동자들의 합법적인 노동조합 행동권을 탄압하기 위해 남용하고 있다는 데 있습니다.
이러한 반노동조합적 행동들은 ILO 협약 제87조(결사의 자유와 단결권 보호에 관한 협약, 1948)와 98조(단결권과 단체협상권 원칙에 관한 협약, 1949)에 위배됩니다. 이러한 협약들은 가장 기본적인 것으로 간주되어야 하며, 비록 한국 정부가 비준하지는 않았지만, 위 협약들에 담겨 있는 원칙들을 존중하고 집행하는 것이 ILO 회원국으로서의 의무입니다. 따라서 ICFTU는 한국 노동법-노동조합및노동관계조정법-의 개혁, 그리고 노동자들의 단체행동권을 탄압하기 위한 목적으로 사용자들이 부당하게 손해배상 제도를 활용하는 것을 금지해줄 것을 강력하게 요구합니다.

Dear Mr. President,
The use of Korea's legal system to repress trade union and workers' rights
The International Confederation of Free Trade Unions(ICFTU), which represents 158 million workers in 150 countries and territories, including your own, hereby firmly denounces the recent, serious developments in the Republic of Korea, which have resulted in a series of suicides by Korean metalworker trade unionists.
The ICFTU believes the root cause of these tragic deaths to be the continued repression of trade union rights and activities in South Korea, e.g. via companies filing heavy damage suits and having property of not only the unions but also individual union members put under provisional seizure.
Different from that of other countries, Korean civil law stipulates that an individual who has committed an illegal act is subject to damage claims. On the other hand, Korean labour law sets limits to workers' legal collective action, which is more or less systematically amounts of money. The main problem is therefore not about the legal system of damage suits or provisional seizures, but about the legal system being misused by employers in order to repress workers' rights to legal trade union action.
These anti-union actions contravene ILO Conventions 87(on Freedom of Association and Protection of the Right to Organise, 1948) and 98(on the Right to Organise and Collectively Bargain, 1949). These instruments are considered fundamental and although Korea did not ratify them. It has an obligation arising from its ILO membership strongly urges a reform of Korea's labour law-namely the Trade Union and Labour Relations Adjustment Act- and the restriction of employers' improper use of damage claims for the purpose of oppressing workers' rights to collective action.
We would also like to draw your attention to the fact that the Geneva-based International Metalworkers' Federation(IMF) has decided to file a complaint with the International Labour Organization(ILO) against your government. The ICFTU fully backs this complaint and will take whatever action it deems necessary to support it.
We sincerely hope that your will intervene promptly and that your government will take steps to engage in social dialogue and ensure the respect of fundamental trade union rights.
